Restaurant owes state $74K
Lawyer for owners says payments being made

The state of Arkansas filed a tax lien last week against Fire Brand Paragould LLC in the amount of $74,401.68, according to documents filed at the Greene County Circuit Clerk’s office. The lien is in connection with the company’s failure to remit sales and use taxes from January to May 2009, according to the document.
Fire Brand Paragould LLC did business as Whiskey Creek, a restaurant formerly located 3506 Linwood Drive. The restaurant ceased operations several weeks ago and the location reopened as Fender’s Roadhouse in October.
Attorney Roger Colbert, who is listed with the Secretary of State’s office as the incorporator/organizer of Fender’s Roadhouse of Paragould LLC, confirmed the same individuals who were partners in Fire Brand Paragould are also the partners in Fender’s Roadhouse of Paragould.
He said there is an installment plan in place to pay the delinquent taxes, and the owners have been making payments since August.
The new restaurant is currently operating under the Whiskey Creek sales tax permit number, but the owners have requested a new number, which should arrive “any time,” Colbert said. The state Department of Finance and Administration has allowed the owners to obtain a new permit because they are making payments for what’s owed under the old permit, Colbert said.
He said the last year’s economic downturn caused the restaurant to fall behind on the sales tax payments, adding things have improved with the change in concept and menu.
